UPDATE - Bogaerts v. The Attorney General of Ontario - the Government of Ontario launches an appeal


Earlier this year, in the case of Bogaerts v. The Attorney General of Ontario, the court ruled that it is unconstitutional for the Government of Ontario to permit a charity to provide enforcement of its legislation. This week, the Government of Ontario announced that it is appealing this decision.

 This is an issue for the Government of Ontario to address. The Government of Ontario has the option to appeal the ruling‎ and they have done so.

 The Ontario‎ SPCA respects the decision of the court and the rights of all parties involved. We will not comment on the ruling or the legal process.
